What the Regulatory Landscape Actually Looks Like in 2026

Two regulations govern AI processing for most European businesses in 2026. They operate simultaneously and reinforce each other.

GDPR

  • Article 28 — Data processor obligations: When a third-party AI provider processes personal data on your behalf (as is the case when you use OpenAI, Anthropic, or Google APIs), they must be operating under a Data Processing Addendum (DPA) that defines their obligations regarding your data. Using a cloud AI service without a signed DPA in place is a compliance gap.
